Unfortunately, proving who or what caused your injuries is often the most difficult part of a medical malpractice case.
Medical malpractice is medical treatment that falls below the acceptable standard of care and causes a patient harm. If you are harmed by a medical provider, you have the burden to prove that a medical professional deviated from the acceptable standard of care and caused you harm as a result.
Normally, proving that a medical provider deviated from an acceptable standard of care involved, determining what the acceptable standard of care is in the given situation, and then assessing whether the medical provider’s care fell below that standard. Once the patient is able to prove that care fell below a certain standard, then the patient needs to prove that the standard of care was the cause of the patient’s harm.
Unfortunately for the patient, proving that substandard care was the cause of the patient’s harm is more difficult than it sounds. If the harm occurred during surgery, the surgeon may point out that there are often complications to surgical procedures, many of which are not the fault of the surgeon. If a doctor fails to diagnose a serious illness and the patient becomes worse, it can be hard to prove that the patient’s condition would have improved if the doctor had discovered the illness sooner.
