In many situations, the drug error is a result of an individual’s negligence. When pharmacists get busy, it can be easy to make an error with a medication. Unfortunately, this can result in a patient becoming violently ill, developing a life-threatening condition, or even dying.
In pharmacy error lawsuits, there are a number of common factors that are typically involved in the error. The wrong medication may have been given. The prescription may have been illegible. The prescription may have been filled with a drug with a similar name to the prescribed drug. The wrong medication may have been prescribed. The wrong dosage may have been given. The wrong directions for administering the drug may have been given. The side effects of taking the drug may not have been properly explained. The doctor or pharmacist may not have reviewed the patient’s history of drug interactions.
Pharmacies have a legal duty when they fill a prescription for a patient. Pharmacies have the duty to check the prescription for accuracy, as well as explaining how to take the medicine. Not all errors are the result of pharmacy negligence, however. Doctors, hospitals, or other medical providers may also be responsible.
