Makeup Recalled Over Possible Asbestos Contamination

Claire’s, a jewelry store with products marketed towards young girls, has issued a recall for the second time in three months. Both recalls were issued for its makeup products, which were found to contain asbestos.

The JoJo Siwa Makeup Set has been recalled, after the product tested positive for asbestos during the FDA’s ongoing investigation of asbestos contamination in makeup. According to a Claire’s spokesperson, the FDA’s testing indicated the possible presence of trace amounts of asbestos fibers in the powder eyeshadow element of the makeup kit.

The company said it will provide a full refund to anyone who purchased the makeup set. The company also removed three other makeup items from stores in March, after the FDA confirmed the presence of asbestos in the makeup. According to Claire’s, it has switched to talc-free manufacturing for all of its cosmetics.

Exposure to asbestos dust can cause very serious health conditions decades after the exposure, including mesothelioma and lung cancer. Under the Federal Food, Drug, and Cosmetic Act, the FDA cannot enforce a recall of potentially dangerous cosmetics. It also is not required to review and approve makeup products before they are sold, since many cosmetics do not pose the same risks as other products, such as medical products.

Companies, particularly companies that market and sell products to children, have a duty to make products which are safe for their intended use. If a company fails to do so and a consumer is harmed, the company can be held liable as a result.
