Fortunately, most employers in Houston are honest and pay their employees all of the pay that they have earned. However, there are some dishonest employers who take advantage of their employees. They may refuse to pay employees what they have earned, which can include not only wages, but also overtime, bonuses, sick time, and vacation time. This commonly happens when workers are vulnerable to their employers, such as if they are here illegally or do not speak English well.
If that happens, the employees have the right to sue their employers. Typically, an employee should consult with an employment attorney, who can stand up for their legal rights and let employers know that their employees cannot be taken advantage of.
Some common violations of the law include when workers are not paid for all of the hours they work, they are not paid time and a half for overtime, they are not given meal breaks and rest breaks, they are not paid for accrued sick leave or vacation time, they are not paid all of their bonuses and commissions earned, and they are not paid for all unused vacation time upon leaving the company. Employees are often mischaracterized as independent contractors under the law, instead of employees, which can help the employers shirk their legal obligations to the workers.
