Mining workers often work some of the longest and most demanding shifts of any industry, making overtime pay a critical part of their income. Yet unpaid overtime remains one of the most common labor violations in mining. Whether through intentional payroll manipulation or simple negligence, employers who fail to pay overtime are breaking federal law — and mining workers have the right to pursue overtime claims to recover what they are owed.
Mining overtime claims frequently arise from the misclassification of employees. Companies may label miners as “exempt” or as independent contractors to avoid paying overtime, even when their job duties clearly require overtime compensation. Other employers require miners to perform tasks before or after their recorded shifts, such as pre-inspections, equipment retrieval, travel within the mine, or cleanup duties. All these activities count as work time under the Fair Labor Standards Act (FLSA) and must be paid accordingly.
Another common violation involves automatic meal break deductions. Even when miners work through lunch or cannot safely take a break, some employers still deduct 30 to 60 minutes of unpaid time. Over weeks and months, these false deductions can add up to significant unpaid wages. Supervisors may also encourage workers to underreport hours or discourage them from recording overtime altogether — actions that directly violate federal labor law.
Miners who file overtime claims may be entitled not only to unpaid wages but also to liquidated (double) damages, interest, and attorney fees. In cases where multiple workers are affected, claims may be filed as collective actions, giving miners the strength of numbers and increasing pressure on employers to settle fairly. Pursuing an overtime claim is not only about recovering lost pay — it’s about holding employers accountable and preventing future exploitation of the workforce.
